Acceptance of Terms

By accessing and using BaristaCard, you accept and agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our service.

Description of Service

BaristaCard is a digital loyalty card platform that connects coffee shop customers with participating cafés. The service allows customers to:

  • Collect stamps for purchases at participating cafés
  • Earn Coffee Beans (loyalty points) across all venues
  • Redeem rewards for free coffee
  • Track progress via web and digital wallet passes

The service allows café owners to:

  • Create and manage digital loyalty programs
  • Award stamps and track customer engagement
  • Configure custom loyalty deals
  • Access analytics and insights

User Accounts

Guest Users

You may use BaristaCard as a guest without registration. Guest data is stored locally and via a persistent cookie. You are responsible for maintaining your guest session; we cannot recover lost guest data.

Registered Users

To preserve your data across devices, you may register via Google or Facebook OAuth. By registering, you:

  • Agree to provide accurate information
  • Are responsible for maintaining the security of your account
  • Must not share your account with others
  • Must notify us immediately of any unauthorized use

Café Owners

Café owner accounts are subject to verification. We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

Acceptable Use

You agree not to:

  • Use the service for any illegal purpose
  • Attempt to defraud or abuse the loyalty system
  • Share, sell, or transfer stamps or rewards
  • Create multiple accounts to gain unfair advantage
  • Reverse engineer, hack, or compromise our systems
  • Scrape, crawl, or collect data without permission
  • Impersonate other users or café owners
  • Interfere with the service's operation or security

Loyalty Program Rules

Stamps and Rewards

  • Stamps are awarded at the discretion of café owners for qualifying purchases
  • Stamps have no cash value and cannot be transferred
  • Rewards must be redeemed at the café that issued them
  • Each reward can only be redeemed once
  • Café owners reserve the right to refuse service or redemption

Coffee Beans

  • Coffee Beans are earned by completing stamp cards
  • Beans have no cash value and cannot be transferred or sold
  • Bean expiration (90-day decay) may be implemented in the future
  • Bean balances are tracked server-side and are final

Café Owner Responsibilities

As a café owner using BaristaCard, you agree to:

  • Honor all valid rewards presented by customers
  • Award stamps fairly for qualifying purchases
  • Not manipulate or abuse the system
  • Comply with all applicable laws and regulations
  • Provide accurate café and deal information
  • Not use customer data for purposes outside BaristaCard

Pricing and Service Fees

Current Pricing

BaristaCard is currently free for both café owners and customers. You can create loyalty programs, award stamps, earn rewards, and use all features at no cost.

Future Pricing Changes

We reserve the right to introduce paid subscription plans or service fees for café owners in the future. When we decide to implement pricing:

  • We will notify all café owners via email at least 30 days in advance
  • The notification will include detailed pricing information and plan options
  • Café owners will have the option to accept the new pricing or discontinue service
  • Existing loyalty data and customer progress will be preserved during any transition period
  • The customer-facing service will remain free—customers will never be charged to collect stamps or redeem rewards

We are committed to providing advance notice and transparent communication about any pricing changes. Our goal is to build a sustainable platform while keeping the service accessible and valuable for café owners.

Intellectual Property

BaristaCard and all related trademarks, logos, and content are owned by us or our licensors. You may not use our intellectual property without explicit permission. Café owners grant us a license to display their café name, logo, and deal information on our platform.

Disclaimers and Limitations of Liability

BaristaCard is provided "as is" without warranties of any kind. We do not guarantee:

  • Uninterrupted or error-free service
  • Accuracy of café information
  • Availability of specific rewards
  • Recovery of lost guest data

To the maximum extent permitted by law, we are not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Actions or omissions of café owners
  • Third-party services (OAuth providers, wallet services)

Modifications to Service and Terms

We reserve the right to:

  • Modify or discontinue the service at any time
  • Update these Terms of Use
  • Change loyalty program rules
  • Add or remove features

Significant changes will be communicated via email or in-app notification. Continued use after changes constitutes acceptance.

Termination

We may suspend or terminate your access to BaristaCard at any time for violations of these terms, fraudulent activity, or other legitimate reasons. You may delete your account at any time by contacting us.

Governing Law

These Terms of Use are governed by the laws of [Your Jurisdiction]. Any disputes shall be resolved in the courts of [Your Jurisdiction].

Dispute Resolution

Before filing any legal claim, you agree to attempt to resolve the dispute informally by contacting us at legal@baristacard.com. We will work in good faith to resolve the issue within 30 days.
