Acceptance of Terms
By accessing and using BaristaCard, you accept and agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our service.
Description of Service
BaristaCard is a digital loyalty card platform that connects coffee shop customers with participating cafés. The service allows customers to:
- Collect stamps for purchases at participating cafés
- Earn Coffee Beans (loyalty points) across all venues
- Redeem rewards for free coffee
- Send tips to baristas at participating cafés
- Track progress via web and digital wallet passes
The service allows café owners to:
- Create and manage digital loyalty programs
- Award stamps and track customer engagement
- Configure custom loyalty deals
- Receive payouts for café revenue
- Access analytics and insights
The service allows baristas and staff to:
- Receive digital tips from customers
- Set up payout preferences for tip earnings
- Track tip history and earnings
User Accounts
Guest Users
You may use BaristaCard as a guest without registration. Guest data is stored locally and via a persistent cookie. You are responsible for maintaining your guest session; we cannot recover lost guest data.
Registered Users
To preserve your data across devices, you may register via Google or Facebook OAuth. By registering, you:
- Agree to provide accurate information
- Are responsible for maintaining the security of your account
- Must not share your account with others
- Must notify us immediately of any unauthorized use
Café Owners
Café owner accounts are subject to verification. We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.
Café owners who receive payouts via manual bank transfer (rather than Stripe Connect) must complete identity verification (KYC) before payouts can be processed. See the Identity Verification section below for details.
Baristas and Staff
Baristas and staff are added by café owners. Staff accounts that receive tip payouts via manual bank transfer must complete identity verification (KYC). Staff using Stripe Connect are verified through Stripe's own processes.
Acceptable Use
You agree not to:
- Use the service for any illegal purpose
- Attempt to defraud or abuse the loyalty system
- Share, sell, or transfer stamps or rewards
- Create multiple accounts to gain unfair advantage
- Reverse engineer, hack, or compromise our systems
- Scrape, crawl, or collect data without permission
- Impersonate other users or café owners
- Interfere with the service's operation or security
Loyalty Program Rules
Stamps and Rewards
- Stamps are awarded at the discretion of café owners for qualifying purchases
- Stamps have no cash value and cannot be transferred
- Rewards must be redeemed at the café that issued them
- Each reward can only be redeemed once
- Café owners reserve the right to refuse service or redemption
Coffee Beans
- Coffee Beans are earned by completing stamp cards
- Beans have no cash value and cannot be transferred or sold
- Bean expiration (90-day decay) may be implemented in the future
- Bean balances are tracked server-side and are final
Café Owner Responsibilities
As a café owner using BaristaCard, you agree to:
- Honor all valid rewards presented by customers
- Award stamps fairly for qualifying purchases
- Not manipulate or abuse the system
- Comply with all applicable laws and regulations
- Complete identity verification (KYC) when required to receive payouts
- Provide accurate café and deal information
- Not use customer data for purposes outside BaristaCard
- Only send broadcast messages to customers through BaristaCard in accordance with these Terms and applicable laws
- Not use broadcasts for spam or unlawful marketing
Identity Verification (KYC)
When Verification Is Required
Café owners and baristas who receive payouts via manual bank transfer (café revenue or tips) must complete identity verification before payouts can be processed. Users who connect via Stripe Connect are verified through Stripe's own processes and do not need to complete BaristaCard's verification.
What You Must Provide
Depending on your account type, you will be asked to submit:
- Individual accounts: Full legal name, date of birth, nationality, country of residence, a photograph of a government-issued ID (front and back where applicable), and a selfie photograph of you holding the document
- Business accounts: All of the above, plus registered business name, registration number, country and address of registration, and a business registration document
Your Obligations
- All information and documents you submit must be accurate, genuine, and up to date
- You must not submit forged, altered, or fraudulent documents
- You must promptly update your information if it changes
- Submitting false or misleading verification documents is a serious violation of these Terms and may result in immediate account termination and referral to the relevant authorities
Review Process
Submissions are reviewed by our team, typically within 1–2 business days. We may request additional information or documents if needed. We reserve the right to reject a submission and request resubmission.
Payout Restrictions
Payouts will not be processed until identity verification has been approved. If your verification is rejected, pending payouts will be held until a successful resubmission is approved. We reserve the right to withhold payouts indefinitely if verification cannot be completed.
Communications
BaristaCard may send users service-related communications (such as account confirmation and password resets). Cafés may also send broadcast announcements to their customers via BaristaCard. Users may opt out of café broadcast emails.
Pricing and Service Fees
Subscriptions
BaristaCard offers subscription plans for café owners. Subscription pricing and plan details are shown in the billing section of your account.
The customer-facing service remains free—customers are never charged to collect stamps or redeem rewards.
Support
We currently provide email support only.
Billing, Upgrades, and Downgrades
- Subscriptions are billed in advance on a recurring basis (e.g., monthly), unless otherwise stated at checkout
- You can change or cancel your subscription through the billing section of your account
- If you upgrade to a higher plan, the upgraded plan may take effect immediately
- To prevent multiple renewals, we may cancel or schedule cancellation of older subscriptions associated with the same account
No Refunds
Unless required by law, subscription fees are non-refundable. We do not provide refunds or credits for partial billing periods, unused time, or plan changes.
Pricing Changes
We may change plan pricing, plan features, free-tier allowances (including the number of free venues), and the scope of any free or promotional offer at any time, in our sole discretion. Where "first venue free" or similar wording appears on our marketing pages or within the product, it describes the current offer and does not constitute a permanent or perpetual entitlement.
Any such change will apply only to accounts created on or after the date the change is announced. Accounts that were already enrolled in a free tier or that already had a free venue at the time of the announcement will continue to receive that free tier or free venue on the same terms (subject to continued compliance with these Terms). Changes will not affect subscription fees already paid for the current billing period. Material changes will be communicated by email or in-app notification.
Broadcast Limits
Broadcast messaging allows café owners to send announcements to their customers. Broadcast limits vary by subscription plan:
- Free plan: 1 broadcast per week
- Basic plan: 1 broadcast per day per venue
- Premium plan: 2 broadcasts per day per venue
- Enterprise plan: Unlimited broadcasts
Broadcast limits reset on a rolling basis (weekly or daily depending on your plan). Unused broadcasts do not carry over.
Product Cards
- Product cards are prepaid bundles sold by the café owner, not by BaristaCard
- BaristaCard acts solely as a technology platform facilitating the transaction and payment processing
- Product cards are non-refundable once purchased; refund requests must be directed to the café owner
- The café owner is solely responsible for honouring the product card at their venues
- If a café closes, ceases operations, or otherwise fails to honour a product card, BaristaCard bears no liability for unredeemed items or any financial loss
- Product cards have no expiry date unless explicitly set by the café owner
- BaristaCard is not responsible for changes to the items, quality, or availability offered by the café
Subscription Deals
- Subscription deals are recurring agreements between the customer and the café owner
- BaristaCard facilitates recurring billing via Stripe on behalf of the café owner
- Customers may cancel their subscription at any time; cancellation takes effect at the end of the current billing period
- Café owners may modify or discontinue a subscription deal; existing subscribers will be notified of material changes
- BaristaCard is not liable for the quality, availability, or fulfilment of subscription benefits — that is solely the café owner's responsibility
- If a café ceases operations, active subscriptions will be cancelled and BaristaCard will not be liable for any remaining subscription period
Platform Role and Marketplace Disclaimer
- BaristaCard is a technology platform and marketplace facilitator, not a merchant of record
- All commercial relationships involving product cards, subscription deals, loyalty programmes, and other café offerings are exclusively between the customer and the café owner
- BaristaCard facilitates payment processing but does not control pricing, product quality, availability, or fulfilment
- BaristaCard charges a platform fee to café owners as a service charge for facilitating transactions; this fee is not charged to customers
- BaristaCard makes no warranties or representations about any café, their products, services, or their continued operation
Intellectual Property
BaristaCard and all related trademarks, logos, and content are owned by us or our licensors. You may not use our intellectual property without explicit permission. Café owners grant us a license to display their café name, logo, and deal information on our platform.
Wallet Passes
- Apple Wallet and Google Wallet passes are provided as a convenience feature
- Pass data may not update in real time; the BaristaCard website is the authoritative source for card balances and status
- BaristaCard is not responsible for Apple Wallet or Google Wallet app behaviour, display issues, or pass delivery failures
- Users should verify their card status on the BaristaCard website if their wallet pass appears outdated
Disclaimers and Limitations of Liability
BaristaCard is provided "as is" without warranties of any kind. We do not guarantee:
- Uninterrupted or error-free service
- Accuracy of café information
- Availability of specific rewards
- Recovery of lost guest data
- That any café will honour product cards, subscription deals, or loyalty rewards
To the maximum extent permitted by law, we are not liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, or business opportunities
- Actions or omissions of café owners
- Third-party services (payment processors, OAuth providers, wallet services)
- Unredeemed product cards or subscription benefits if a café ceases operations
Aggregate liability cap: BaristaCard's total aggregate liability arising from or related to these terms shall not exceed the total fees actually paid by you to BaristaCard in the twelve (12) months preceding the claim. This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise).
Modifications to Service and Terms
We reserve the right to:
- Modify or discontinue the service at any time
- Update these Terms of Use
- Change loyalty program rules
- Add or remove features
- Change, reduce, or remove free-tier allowances and free or promotional offers for future accounts (see Pricing Changes above for how existing accounts are grandfathered)
Significant changes will be communicated via email or in-app notification. Continued use after changes constitutes acceptance.
Termination
We may suspend or terminate your access to BaristaCard at any time for violations of these terms, fraudulent activity, or other legitimate reasons. You may delete your account at any time by contacting us.
Governing Law
These Terms of Use are governed by the laws of [Your Jurisdiction]. Any disputes shall be resolved in the courts of [Your Jurisdiction].
Dispute Resolution
Before filing any legal claim, you agree to attempt to resolve the dispute informally by contacting us at legal@baristacard.com. We will work in good faith to resolve the issue within 30 days.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
